Understanding Health Insurance Portability and Accountability Act

The Health Insurance Portability and Accountability Act or HIPAA has two purposes. The first, “portability,” allows an employee to keep their current health insurance even if they should happen to leave their current place of employment. This is easily done thanks to plans such as COBRA. The second part, “accountability,” means that the government can now regulate healthcare providers, health plans, payers, clearinghouses, and anyone else that might coordinate health data, for complete privacy and security. If an employer provides any type of on-site health care, that employer must also comply by HIPAA standards.
It means that if personal information is stored on computer databases, tapes, disks, or transmitted with the assistance of faxes or the Internet, in addition to anything written down or talked about, steps must be taken to ensure a patient’s privacy. This also means that, in addition to protecting your privacy, the electronic exchange of financial or administrative information must now be standardized.
Penalties for non-compliance can include fines that range from $100 per person per violation up to $25,000 per year and/or up to ten years imprisonment.
The process is complaint driven and only covers health care providers and health plans. It doesn’t mean that a friend or family member can’t discuss someone’s medical issues with another party. Relatives may talk freely about what they may have discussed with health care providers. Journalists may report on a subject’s medical condition, but the information that can be disclosed by a doctor or hospital is limited. These restrictions also don’t apply to police, firefighters, coaches, trainers or teachers.
If you feel your privacy has been violated, you can issue a complaint with your healthcare provider or the DHHS. Your health information is privileged and anyone can use this information against you. The HIPAA was designed to combat this. Your health care professional now has to make sure your information stays confidential unless you request otherwise.

How To Safely Navigate Your Company To A Healthy Destination

Florida health insurance approval often seems like a confusing track with twists of jargon and blind curves. But underwriting departments, the areas that decide on health insurance coverage, have rules of the road that carefully guide the process. For each client the underwriters evaluate the risk of insuring individuals and then decide on appropriate coverage and costs. Use this guide to help you navigate the process for your business.
The Major Arteries
In general, commercial insurance plans in Florida fall into three territories: individual, small group, or large group. The State of Florida defines small groups as companies with 50 or fewer employees and large groups as business with 51 employees and up. Risk evaluation is also regulated by the state. Depending on the policies, insurance companies may review applicants’ medical backgrounds and decide whether to accept or deny applications.
Lone Ranger: Individual Insurance Coverage. Any individual not on another medical plan can apply for individual insurance coverage. Individual medical insurance is the only kind where companies can deny an application on an individual basis. High-risk individuals may not be able to get this type of insurance. The lowest, standard price for individual healthcare plans is determined by age and gender. Sometimes applicants with health issues are accepted, but they may have to pay a higher rate. For example someone with moderate asthma would pay more than someone who did not have asthma. Other times, health insurance providers will exclude a particular condition from coverage for a particular period of time.
Caravan Journey: Small Group Insurance Coverage. In order to qualify for small group coverage, an employer must meet minimum requirements. These include whether an employer is a legitimate business, and most importantly verification that the employees truly work at the company. Government regulations prevent insurance companies from denying coverage to individuals within small group plans based on medical conditions. People that would not qualify for an individual healthcare plan would be eligible for health coverage in a small group plan.
Small group pricing is based on a standard rate that is an average of the risk associated with each of the individuals in the group. Within a small group plan, individuals can pay up to 15 percent more or less than the standard rate, depending on their medical condition. Healthy individuals could end up paying more in a small group plan than on an individual plan because the rates are determined by the composition of the whole group.
Rush Hour: Large Group Insurance Coverage
Large group coverage has many similarities to small group coverage. Employers and employees need to satisfy similar eligibility requirements.
Insurance companies are also prohibited from denying coverage to specific people within a large group plan because of a medical condition. Pricing within a large group is based on a weighted average of risk among all of the employees and on which type of plan employees choose.
Improving Your Medical Mileage
Business owners need to decide on their goals from a financial and social benefit standpoint and allow those objectives to guide their conclusions about company healthcare. Insurance prices can vary dramatically for similar coverage and doctors within an area, so employers should shop around for the best value. Another consideration for business owners is what percentage of healthcare costs do they want to take on versus how much they want their employees to pay. The more employees pay in monthly premiums and in out-of-pocket expenses, the less business owners need to pay. However, medical benefits can be used as a retention incentive, so it could be to employers advantage to take on a large portion of medical costs.
On the social side, employers can check if a medical plan will cover the special needs of a particular employee. Due to the high level of regulation, large group medical plans will most likely be required to cover treatments. Another medical insurance scenario is where individuals are given a choice between company or individual insurance. In general, this doesn’t benefit the company as a whole. If the least healthy individuals are the only ones left in the group plan, medical costs can rise to high levels. The people on individual plans may benefit in the short-term but they’re hurting their fellow employees. Also, they’re possibly hurting their ability to get reasonably priced health insurance in the future when they’re not in as good of health.

In Business For Yourself? Better Look Into Disability Insurance

If you’re in business for yourself, either alone or with just a few employees, a long-term disability can easily mean bankruptcy or could even shove you into homelessness.
The only way to protect yourself from these possibilities is with disability insurance. But there are three types and you need to know the differences.
The kinds of disability insurance
There are three kinds of disability insurance available. The first of these is Own-Occupation Disability Insurance. This is the only type of insurance that does not penalize you for going back to work in a different occupation while on a claim.
Why can this be important? If you become disabled and are like most people, you not going to want to just sit around the house for many months. So, with this type of insurance, you could go back to work in some job where you are not totally disabled.
The second type of disability insurance is called Income Replacement Insurance. This has become the most common type offered by insurance companies today. This type of insurance will penalize you during a claim if you decide to go back to work or earn another source of income.
The penalty usually takes the form of a decreased monthly check as the insurance company will offset some of what it owes you based on your other income.
The worst definition
The third type of disability insurance is Gainful Occupation Coverage. This is the worst kind of disability insurance because it defines disability as “because of sickness or injury, you are unable to perform the material and substantial duties of your occupation, or any occupation, for which you are deemed reasonably qualified by education, training or experience.
The problem with this definition is that it is too subject to interpretation. What you think you are reasonably qualified to do by education, training or experience could be far different from what the insurance company thinks. It’s doubtful the insurance company could decide you’re qualified to go back to work flipping burgers but, at least theoretically, this could happen.
If you’re in business for yourself, you need disability insurance. But don’t make the mistake of buying the cheapest available. Shop around before you buy to make sure you’re getting the best value. You might find you can afford the Own-Occupation Disability Insurance and that’s, by far, the best option.

If you’re considering “selling” your life insurance policy you must have some understand the potential tax consequences of the sale.

As a life settlement of an insurance policy is in effect the sale of the policy to a third-party, and not a surrender of the policy to the insurance company. Actually, the policy doesn’t need to have a cash value to be eligible for a life settlement transaction. The tax implications are twofold, and are relatively complex. While the IRS has not issued definitive guidance on life settlement transactions, it has relied on the application of its laws and regulations that address similar situations.

Basic income tax concepts clearly indicate that gains and losses are computed by taking the selling price of an item and reducing it by any selling expenses and the investment in the item. The investment in the item is known as its “basis.” When dealing with life insurance policies, the basis in the policy is the total of all premium payments made on the contract. The amount of basis in the policy has a direct bearing on the amount of gain to be recognized from both a surrender and settlement transaction. In general, the basis computation is straight-forward, simply being the sum of the premiums paid to the insurance company.

When a surrender of a policy to the issuing insurance company occurs, the difference between the surrender proceeds and the basis in the policy is subject to income tax at ordinary income rates. This concept is important, as it is the first taxable gain computation performed in a settlement transaction. In effect, this surrender value minus basis gain is treated identically whether the policy is surrendered or settled. If the surrender value is lower than the basis, there is no ordinary gain to be reported and the proceeds are treated as a return of basis without a tax cost.

The second taxable gain computation is unique to a settlement transaction, and results in a gain that is subject to tax at favorable capital gain rates. In this computation, the settlement proceeds are compared to the surrender value used in the ordinary gain determination. Because a settlement transaction involves selling the contract, and the insurance contract is treated as a capital investment, this portion of the gain is treated as a capital gain.
